Proclamation Enumerating Certain Prohibitions & Restrictions Imposed During a State of Emergency – April 9, 2020

DECLARATION OF THE MAYOR OF EMERALD ISLE
ENUMERATING CERTAIN PROHIBITIONS & RESTRICTIONS
IMPOSED DURING A STATE OF EMERGENCY

In accordance with the provisions of Chapter 7, Emergency Management, of the Emerald Isle Town Code, Section 7-1 – State of Emergency, and Section 7-2 –Prohibitions, Restrictions Authorized, a State of Emergency has been declared to exist in the Town of Emerald Isle.

WHEREAS, by Proclamation the Mayor declared a State of Emergency for the Town of Emerald Isle on March 19, 2020 as a result of the threat to the health, safety and welfare of the community from the coronavirus (COVID 19) pandemic; and

WHEREAS, subsequently, public health authorities at the local, state and national levels have urged citizens to stay home as a means of slowing or thwarting the spread of the virus; and

WHEREAS, subsequently, the Governor of North Carolina has issued a mandatory shelter in place order; and

WHEREAS, transient visitors from areas in the state or nation with high infection rates, shall remain sheltered in their primary state or area of residence, so to limit the spread of the virus; and

WHEREAS, travel from outside Carteret County for outdoor or leisure activities within Emerald Isle is not considered essential travel and his hereby prohibited.

NOW, THEREFORE, BE IT PROCLAIMED AND DECLARED by Eddie Barber, Mayor of the Town of Emerald Isle that:

Self-Quarantine Requirements. Effective commencing at 11:59 PM on Thursday, April 9, 2020, all residents and non-residents of Emerald Isle arriving for overnight stays are ordered, while present in Emerald Isle, to self-quarantine for a period of 14 days if such arrival was preceded by an overnight stay outside of Carteret County.

The only exceptions to this provision are those who are performing Essential Services or Essential Government Services as those capitalized terms are defined in that certain Revised Proclamation of the Chairman of the Carteret County Board of Commissioners dated March 27, 2020.

TOWN OF ATLANTIC BEACH COVID-19 UPDATE

Today Mayor Trace Cooper has added to our State of Emergency Declaration.

Effective 11:59 PM on Thursday, April 9, 2020, all residents and non-residents of Atlantic Beach arriving for overnight stays are ordered, while present in Atlantic Beach, to self-quarantine for a period of 14 days if such arrival was preceded by an overnight stay outside of Carteret County.

The only exceptions to this provision are those who are performing Essential Services or Essential Government Services as those capitalized terms are defined in that certain Revised Proclamation of the Chairman of the Carteret County Board of Commissioners dated March 27, 2020.

Supplemental Emergency Order
Coronavirus (COVID 19)
ENUMERATING CERTAIN PROHIBITIONS & RESTRICTIONS IMPOSED DURING A STATE OF EMERGENCY

WHEREAS, on March 13, 2020, I as Mayor of the Town of Pine Knoll Shores, declared a state of emergency within the city limits of the town as a result of the threat to the health, safety and welfare of the community from the coronavirus (COVID 19) pandemic; and

WHEREAS, subsequently, public health authorities at the local, state and national levels have urged citizens to stay home as a means of slowing or thwarting the spread of the virus; and

WHEREAS, subsequently, the Governor of North Carolina has issued a mandatory shelter in place order; and

WHEREAS, persons from areas in the state or nation with high infection rates, should remain sheltered in their primary state or area of residence, so to limit the spread of the virus; and

WHEREAS, I am determining that travel from outside Carteret County for outdoor or leisure activities within Pine Knoll Shores is not considered essential travel and is hereby prohibited.

NOW, THEREFORE, BE IT PROCLAIMED AND DECLARED pursuant to N.C. General Statutes §§166A-19.22 and 166A-19.31 and Chapter 18 of the Pine Knoll Shores Town Code, the Declaration of State of Emergency I issued on March 13, 2020 is amended to include the following:

1. Self-Quarantine Requirements. Effective commencing at 11:59 PM on Sunday, April 12, 2020, all residents and non-residents of Pine Knoll Shores arriving for overnight stays are ordered, while present in Pine Knoll Shores, to self-quarantine for a period of 14 consecutive days if such arrival was preceded by an overnight stay outside of Carteret County.

“Self-quarantine,” as used herein means to remain at all times within the interior of the person’s living quarters and to not receive any visitors within the living quarters other than members of the person’s immediate family.

Exempted from self- quarantine are:

(a) travel for the sole purpose of seeking crucial medical attention,

(b) escaping a life- threatening emergency within the living quarters,
(c) receiving emergency service from first responders within the living quarters,

(d) Individuals employed in the following fields when needed to work during the quarantine:

i. Healthcare
ii. Law enforcement
iii Fire & EMS personnel
iv Long term care personnel
v Residential support facility personnel
vi Public health & emergency management personnel
vii Utilities
viii Military
ix News media

Physical shopping trips whether for groceries or other items are not permitted during self-quarantine and no outdoor activities are permitted for the person under self-quarantine.

2. Registration of Persons Subject to Self- Quarantine. Those persons arriving after 11:59PM on Sunday, April 12, 2020 who are subject to self-quarantine are ordered to email PKS Police Chief Ryan Thompson at rthompson@townofpks.com, or to call him at 252-247-2474, and provide the following information
a) List of names of all arriving in Pine Knoll Shores
b) Address where you will be residing
c) Where you are coming from
d) Expected length of stay
e) Phone Number where you can be reached

3. Curfew. Effective Thursday after 11:59 PM on Thursday, April 9, 2020 a curfew will take effect each night between the hours of 10:00 PM and 5:00 AM within the corporate limits of the Town of Pine Knoll Shores and during the curfew it shall be unlawful for any person(s) to be at any location other than their place of residence for any purpose, with the following exceptions:

a) A place of work deemed essential under Governor Cooper’s Executive Order Number 121, and travel to and from such place of work.

b) Travel for emergency medical attention.

c) Travel along Hwy 58.

4. Travel Restrictions. Travel to and within the Town of Pine Knoll Shores is limited to Carteret County property owners and their immediate family members or members of their households with which they typically reside with the following exceptions:

a) Persons who are traveling in a manner consistent with Governor Cooper’s Executive Order Number 121.

b) Through travel/through traffic shall not be restricted on any state-maintained roadway (NC 58).

c) Travel to and from essential businesses and for essential purposes as defined in Governor Cooper’s Executive Order Number 121 shall not be restricted.

d) Persons who reside in a property that is rented so long as the rental term is longer than 30 days.

Travel permitted in this section shall have no effect on the requirement of self-quarantine in section 1 above.
